These Terms of Use (“Terms”) govern your access to and use of youngrealestateutah.com (the “Website”), operated by Young Real Estate, also identified on the Website as The Young Team, affiliated with eXp Realty (“Young Real Estate,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Acceptance of Terms

By using the Website, submitting information, requesting services, or accessing property-search features, you represent that you are legally able to enter into these Terms. Additional written agreements may govern brokerage, representation, listing, buyer-agency, referral, or other real estate services. If a signed agreement conflicts with these Terms, the signed agreement controls for its subject matter.

2. Website Use

The Website provides information about Young Real Estate, residential real estate services, buying and selling homes, new construction, existing and bank-owned properties, property valuation inquiries, communities, featured listings, and property-search tools. Use the Website only for lawful, personal, legitimate real estate-related purposes. You are responsible for information you submit and the security of devices or accounts you use.

3. Real Estate Information

Real estate markets, property conditions, financing, taxes, zoning, schools, measurements, availability, and pricing can change quickly. Website information is general and may not reflect recent developments. Independently verify material facts and consult qualified legal, tax, financial, lending, insurance, inspection, appraisal, engineering, environmental, or construction professionals before making decisions.

4. No Guarantee of Property Availability or Accuracy

We do not guarantee that a property is available, remains for sale, is eligible for a use, or can be purchased on stated terms. Listings may be withdrawn, sold, leased, placed under contract, changed, or become unavailable without notice. Listing details, prices, photographs, square footage, acreage, room counts, descriptions, open-house information, and market estimates may be incomplete, outdated, or erroneous. A home-value estimate is not an appraisal, broker price opinion, guarantee of sale price, or offer to buy or list property.

5. MLS / IDX Information

The Website includes MLS/IDX property information and search technology provided through IDX Broker and properties.youngrealestateutah.com. MLS/IDX data comes from third parties and is intended for consumers’ personal, noncommercial use in identifying prospective properties. Information is deemed reliable but is not guaranteed and is subject to applicable MLS rules, display requirements, data-use restrictions, and copyright notices. You may not scrape, harvest, reproduce, republish, resell, redistribute, create a competing database from, or commercially exploit MLS/IDX data except as expressly permitted.

6. No Agency Relationship Created by Website Use

Visiting the Website, using property-search tools, submitting a form, requesting information, or exchanging email, calls, or texts does not by itself create a buyer-agency, seller-agency, brokerage, fiduciary, confidential, or professional relationship with Young Real Estate, Darin Kidd, Chrissy Young, or eXp Realty. Such a relationship is created only through an appropriate written agreement signed as required by law. Until then, do not send information you consider confidential.

7. Property Listings and Third-Party Information

Listings, maps, photographs, market data, school and neighborhood information, financing information, and other content may come from listing brokers, sellers, MLS organizations, public records, IDX providers, mapping providers, lenders, or other sources. We do not control or guarantee third-party information. Display of a listing does not necessarily mean Young Real Estate is the listing broker or represents the seller. Equal Housing Opportunity principles apply.

8. Informational Content / No Professional Advice

Articles, guides, videos, calculators, market commentary, and home-buying or selling materials are general information, not legal, tax, accounting, financial, lending, insurance, engineering, environmental, appraisal, inspection, construction, or other professional advice.

9. User Submissions and Contact Forms

When submitting a contact form, home-value request, listing inquiry, lead form, or other communication, provide accurate information you are authorized to provide. You authorize us to use it to respond, provide requested real estate information or services, coordinate with relevant providers, keep business records, prevent abuse, and operate the Website as described in our Privacy Policy.

Do not submit unlawful, threatening, defamatory, infringing, malicious, misleading, or confidential third-party material. Submitting an ordinary Website form does not, by itself, constitute consent to receive recurring marketing texts. SMS consent, where requested, must be provided separately and affirmatively.

10. SMS/Text Messaging Terms

Young Real Estate Messaging Program

Young Real Estate is the messaging brand and program operator. If you explicitly opt in to a Young Real Estate SMS/MMS program, you may receive messages relating to your inquiry and requested real estate services, including responses to buying, selling, relocation, listing, or home-valuation inquiries; requested property information; appointment or showing coordination; and service or transaction updates. Promotional or recurring marketing messages will be sent only where you separately and affirmatively opt in as required.

  • You must affirmatively opt in before receiving applicable recurring SMS/MMS messages. Any consent checkbox must be optional and unchecked by default.
  • Consent is not a condition of purchasing goods or services.
  • Message frequency varies with your inquiry, requested services, and interactions.
  • Message and data rates may apply.
  • Reply STOP to unsubscribe from the applicable messaging program.
  • Reply HELP for assistance, email Team@YoungRealEstateUtah.com, or call (801) 897-2662.
  • After opting out, you will no longer receive messages from that program except messages permitted to confirm or process the opt-out. A later opt-in may be required to resume.
  • Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on effective transmission by your carrier/network and is not guaranteed.
  • You are responsible for providing a valid mobile number you own or may use. If it changes or is reassigned, notify Young Real Estate promptly and opt out before relinquishing it.

11. Intellectual Property

The Website and its original text, design, graphics, logos, videos, photographs, layout, and other content are owned by or licensed to Young Real Estate and protected by intellectual-property laws. Third-party marks, listing content, and MLS/IDX data remain their owners’ property. We grant a limited, revocable, nonexclusive, nontransferable license to view and use the Website personally and noncommercially.

12. Acceptable Use

You may not interfere with the Website or security; introduce harmful code; gain unauthorized access; impersonate others; submit deceptive information; scrape or harvest content, listings, or personal information; overload the Website; reverse engineer components except where restriction is prohibited; infringe rights; use Website data for unsolicited marketing; or violate law, MLS rules, carrier requirements, or third-party terms. We may restrict access for violations.

13. Third-Party Websites and Services

The Website may link to or use eXp Realty, IDX Broker, MLS providers, Google services, social platforms, WPForms, Rocket Marketing, Font Awesome, and other technology, analytics, advertising, mapping, communications, or hosting providers. Their services are governed by their own terms and privacy practices. We do not control or assume responsibility for their content, availability, security, or practices.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, PROPERTY INFORMATION, SEARCH TOOLS, ESTIMATES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT UNINTERRUPTED, SECURE, ERROR-FREE OPERATION OR ABSENCE OF HARMFUL COMPONENTS. SOME EXCLUSIONS MAY NOT APPLY TO YOU.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUNG REAL ESTATE, THE YOUNG TEAM, DARIN KIDD, CHRISSY YOUNG, EXP REALTY, AND THEIR AFFILIATES, PERSONNEL, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, OPPORTUNITIES, OR GOODWILL; OR DAMAGES FROM WEBSITE USE, RELIANCE ON CONTENT, PROPERTY UNAVAILABILITY, THIRD-PARTY SERVICES, OR UNAUTHORIZED ACCESS. WHERE LIABILITY CANNOT BE EXCLUDED, AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID, IF ANY, SPECIFICALLY FOR WEBSITE ACCESS DURING THE PRECEDING SIX MONTHS. LIMITATIONS DO NOT APPLY WHERE PROHIBITED.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Young Real Estate, The Young Team, Darin Kidd, Chrissy Young, eXp Realty, and their affiliates, personnel, licensors, and providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful Website use, violation of these Terms, infringement of rights, or submitted information, except where prohibited.

17. Governing Law and Venue

Utah law governs these Terms without regard to conflict-of-law principles. Subject to mandatory law, disputes will be brought in state or federal courts with jurisdiction in Davis County, Utah, and you consent to jurisdiction and venue.

18. Changes to These Terms

We may update these Terms. The “Last updated” date identifies the latest revision. Changes are effective when posted unless stated otherwise. Continued use after effectiveness constitutes acceptance. Material SMS-program changes may also be communicated through an appropriate channel where required.

19. Severability; Waiver; Entire Agreement

If a provision is invalid or unenforceable, it will be enforced to the permissible extent and the remainder stays effective. Failure to enforce is not a waiver. These Terms, the Privacy Policy, and additional service terms form the agreement concerning Website use and do not replace separately signed real estate service agreements.
